Bethalto couple claims they were deceived in buying their home

A Bethalto couple claims the sellers of their home failed to disclose leaking and flooding problems in the basement.


Timothy and Tabitha McDuffie filed a lawsuit March 7 in the Madison County Circuit Court against Richard Torrez, Linda Torrez, Becky Allen, Paul R. Lauschke and Associates Real Estate, Laura Baragiola, Dream Home Realty Centre, Dan Mansmith and Buyers Protection Group.

In their complaint, the McDuffies allege they bought their home at 3 Linden Court in Bethalto after reading through and trusting a disclosure report filed under the Illinois Residential Real Property Disclosure Act, according to the complaint. However, the disclosure report failed to reveal leaking problems in the home’s basement, the suit states.

Because of the basement issues, the McDuffies have incurred out-of-pocket expenses, lost value to their property, lost wages and incurred repair costs, the suit states.

The McDuffies are seeking a judgment of more than $350,000, plus costs, attorneys’ fees and other relief the court deems just. They are being represented by Barbara L. Sherer and Amanda G. Highlander of Edwardsville.
