A man has filed suit against Wal-Mart, saying he fell on a cheesy substance while shopping.
Jacob Weathersby filed a lawsuit March 4 in the St. Clair County Circuit Court against Walmart Supercenter.
According to the complaint, Weathersby was shopping at Wal-Mart at its U.S. 50 location in O’Fallon on March 10, 2012, when he slipped and fell on a cheesy substance that was leaking from a display.
Because of his fall, Weathersby suffered neck, back, shoulder, arm and leg injuries, experienced pain and disability and incurred medical costs, according to the complaint.
Weathersby blames Wal-Mart for causing his fall, saying the store negligently created a dangerous condition by allowing food to remain on the floor, failed to inspect the area, failed to warn the public of the dangerous condition, failed to repair the defective condition and failed to use ordinary care to make the area safe.
Weathersby is seeking a judgment of more than $50,000, plus costs. He will be represented by Shira Truitt of The Truitt Law Firm in Belleville.
