Lipitor suit filed in St. Clair County

Three residents of Illinois and New York have filed suit against the drug company that manufactures a drug used to combat high cholesterol, saying they suffered from diabetes after ingesting the medication.


Rita Hoffman, Patricia Skinner and Carol Tallmadge filed a lawsuit Feb. 14 in the St. Clair County Circuit Court against Pfizer Inc.

According to the complaint, the plaintiffs were taking the medication Lipitor in an attempt to reduce the amount of cholesterol and other fatty substances in their blood. Because of their medication intake, however, the women developed type 2 diabetes, according to the complaint. They blame defendant Pfizer for contributing to their development of the disease, saying the drug manufacturer continued to market the medication as safe, even though it knew of the link to the development of type 2 diabetes.

The plaintiffs allege failure to warn, design defect, negligence, negligent misrepresentation, fraud and breach of warranty against Pfizer.

They are seeking a judgment of more than $450,000, plus costs, attorneys’ fees and other relief the court deems just. They are being represented by John J. Driscoll of The Driscoll Firm in St. Louis.
