Man blames injuries on allegedly intoxicated driver

A man has filed suit against the driver who he claims caused a multi-car rear-end collision.

John Van Buskirk, individually and as next of kin for Niclaus Van Buskirk and Noah Van Buskirk, both minors, filed suit Feb. 18 in St. Clair County Circuit Court against Ryan Braun.

According to the complaint, John was driving a 2013 Chevrolet Malibu south on Greenmount Road near its intersection with Central Park Drive in Shiloh on Dec. 24, 2011, when the defendant, who drove a 1999 Ford F150 in the same direction, struck the back of a vehicle, which rear-ended John’s vehicle. At the time of the collision, John’s sons were riding in the vehicle with him, according to the complaint.

Because of the collision, John and minors Niclas and Noah suffered injuries to their necks, backs and knees, endured great pain and mental anguish and sustained a disability, according to the complaint.

John Van Buskirk blames Braun for causing the collision, saying he drove under the influence of drugs and alcohol, rear-ended a vehicle without attempting to stop, failed to keep his vehicle under proper control, failed to keep a proper lookout, failed to reduce his speed to avoid a collision and drove without adequate brakes.

John Van Buskirk is seeking a judgment of more than $150,000, plus costs. He is being represented by Michael P. Glisson of Williamson, Webster, Falb and Glisson in Alton.

St. Clair County Circuit Court case number 14-L-156.
