Men seek more than $200k following collision

Two men say they sustained various injuries after they collided with a tractor trailer that was attempting to back into a driveway across a busy highway.


David C. Kutz and Kyle D. Kutz filed a lawsuit Feb. 20 in the Madison County Circuit Court against Jeffrey E. Lane and Page Trucking.

In their complaint, the Kutzes allege David C. Kutz was driving a Chevrolet pick-up truck east on U.S. Highway 50 when he encountered Lane, who was driving a white freight-liner truck and a tank trailer.

At or about the hour of 11:08 p.m., the defendant was backing his tractor-trailer into a residential driveway on the south side of U.S. Highway 50, and while backing his vehicle, the defendant backed his tanker truck across the east bound lanes of traffic of U.S. Highway 50 in such a manner so as to occupy both the east bound and west bound lanes, according to the complaint.

As a result, David C. Kutz struck Lane’s vehicle. Both he and Kyle D. Kutz, who was riding as a passenger in the vehicle, sustained serious and permanent injuries, incurred medical costs and endured physical pain and suffering, the complaint says. They also claim they lost earnings.

The Kutzes are seeking a judgment of more than $200,000, plus damages and costs. They are being represented by William S. Beatty of Beatty, Motil and Jones in Glen Carbon.
