Wausau Underwriters sues to recover work comp claim

An insurance company is suing after one of its insureds suffered injuries in a slip and fall incident.


Wausau Underwriters Insurance Co., as subrogee of Select Rehabilitation Inc., and as subrogee of Teresa Hoyt, filed a lawsuit Jan. 22 in Madison County Circuit Court against Maryville Health Properties LLC and Elmwood Nursing and Rehabilitation Center.

According to the complaint, on Jan. 22, 2012, Hoyt was working for Select and on premises owned by Maryville Health Properties, 152 Wilma Drive in Maryville, when she slipped on an accumulation of ice and fell.

The suit states Hoyt was injured from the fall during her normal work activities and received workers' compensation in the amount of $57,496.07 from Wausau. The insurance company is now suing to reclaim the compensation it had to pay Hoyt.

The plaintiff is seeking damages in excess of $50,000, plus court costs. Wausau is represented by attorney Jordan M. Rifkin.
