Wrongful termination suit filed against Jimmy Johns owner

A Madison County resident is suing the owner of a Jimmy Johns restaurant in Alton claiming he was terminated after filing workers' compensation claims.


James R. Cupp filed suit Jan. 17 in the Madison County Ciruit Court against Kidds Restaurants Inc., doing business as Jimmy Johns.

According to the complaint, Cupp was an employee of the defendant. On Dec. 17, 2010, he claims he was injured while in the course and scope of his employment. Cupp was terminated from his employment on Dec. 17. The suit alleges Cupp was terminated because of his exercising his rights under the Illinois Workers' Compensation Act.

Cupp is seeking damages in excess of $50,000, plus cost of suit. He is being represented by D. Jeffrey Ezra of Ezra & Associates LLC.
