Imo's and driver face suit over Route 159 accident

Two St. Clair county residents are suing after sustaining injuries in a collision.


Mark Rives and Sheri McCottrell filed a lawsuit Jan. 2 in the Madison County Circuit Court against Imo's Franchising Inc., Kevin Cowden and Desiree Papproth, citing negligence and respondeat superior.

The complaint states on Nov. 23, 2013, Rives was driving his vehicle, attempting to cross the westbound lane of Illinois Route 158, when Cowden struck the plaintiffs. The plaintiffs state McCottrell was a passenger in Rives' vehicle at the time of the accident. Cowden was driving Papproth's vehicle and working as an employee of Imo's when the accident occurred, according to the complaint. The plaintiffs contend the defendants acted negligently, which caused the collision and resulting injuries.

The plaintiffs are seeking damages in excess of $50,000. Attorneys Charles Armbruster and Mike Blotevogel of Armbruster, Dripps, Winterscheidt & Blotevogel LLC are representing them in the case.
