Raging Rivers sued by mother claiming injury in child rescue

A woman is suing a water park after she suffered a knee injury when she attempted to rescue her child from the pool.


Nicole Davis filed a lawsuit Jan. 7 in Madison County Circuit Court against Raging Rivers Waterpark Inc., citing negligence.

According to the complaint, on July 9, Davis was at Raging Rivers Waterpark and fractured her patella when she struck her knee on an elevated surface of the pool bottom when she went into the pool in an attempt to rescue her child.

The complaint alleges the defendant was negligent in failing to properly train its lifeguards, supervise the lifeguards and failed to train lifeguards in the proper use of the water slide, among other claims.

Davis is seeking damages in excess of the jurisdictional limit.

She is being represented in the case by attorney G. Michael Stewart of Simmons, Browder, Gianaris, Angelides & Barnerd LLC.
