Mascoutah sued over ordinance that owner claims devalues property



Mascoutah officials are facing a lawsuit that claims a rezoning ordinance devalues his property situated within a glide path of nearby Scott Air Force Base.


Hossein Shahpari filed a lawsuit Dec. 13, in St. Clair County Circuit Court against the City of Mascoutah.
According to the complaint, the plaintiff purchased land in 2005 at 9711 Fuesser Road in Mascoutah for $1.2 million. At the time the tract of property, which is adjacent to the Scott Air Force Base, was zoned as light industrial. On June 20, 2011, the defendant changed its comprehensive plan through an ordinance which rezoned the area as an Airport Overlay District.

Shahpari is claiming this rezoning has devalued his property, and is preventing him from using it as its originally intended economic use.

He is seeking more than $50,000 in damages.

Shahpari is being represented in the case by attorney Stanley M. Brandmeyer of Brandmeyer Law Office.
