Limo driver sues after being injured, terminated

A man is suing his former employer after he claims he was terminated for filing workers' compensation claims and hazard reports.


Phillip D. Petty filed a lawsuit Dec. 19 in the Circuit Court of St. Clair County against Pandl Properties Inc., doing business as Kelly's Limousine Service.

According to the complaint, Petty was an employee of the defendant beginning in 2008, working as a driver and mechanic. On Dec. 13, 2011, the plaintiff was injured on the job when a vehicle he was working on collapsed on him, resulting in broken ribs and back injury.

Petty attempted to file a workers' compensation claim for his injuries, but discovered the defendant didn't have the proper insurance, the suit claims. As a result, he reported various safety hazards to the U.S. Occupational Safety and Health Administration, and was subsequently fired from his job Sept. 7, 2012, following subsequent workplace accidents, the suit claims.

Petty is seeking more than $50,000 in damages, plus costs.

He is being represented in the case by attorney Susan M. Andorfer.
