Passenger sues driver over alleged incompetence

A woman has filed suit against the driver who she claims struck a parked vehicle.

Candace Zimmer claims she was riding in a vehicle Matthew Butz was driving north on Lindemann Road in Dupo on April 17 at about 1:30 a.m. when Matthew Butz struck a vehicle that was parked at 111 North Second Street in Dupo.

Because of the collision, Zimmer suffered neck and back pain, incurred nerve damages and endured significant facial scarring, according to the complaint filed Dec. 9 in St. Clair County Circuit Court.

She blames Matthew Butz for causing the collision, saying he negligently failed to keep a proper lookout, failed to see things that were obviously visible, failed to keep his vehicle under control to avoid a collision and failed to use every precaution to avoid a collision, among other negligent acts.

In addition to Matthew Butz, Zimmer also names Mark and Beverly Butz as defendants, saying they negligently allowed their vehicle to be driven by a driver who they knew to be incompetent and careless.

In her complaint, Zimmer is seeking a judgment of more than $50,000, plus costs.
