Strip club patron claims provocation in personal injury lawsuit

A strip club patron accused of striking a visitor at the club denies allegations and claims he was provoked into a scuffle.

According to the complaint filed Nov. 12, Jorden Basford says he was visiting PTs Sports Cabaret in Sauget on Aug. 15 and 16 when defendant Justin Filson allegedly struck him at 2 a.m.

Filson is accused of negligently causing his arm and a glass to come into contact with the plaintiff and failing to act in a safe manner.

Defendant Filson answered the complaint on Dec. 17 through attorney Michael P. Glisson of Williamson, Webster, Falb & Glisson in Alton denying the allegations against him.

Filson filed an affirmative defense arguing that Bosford’s alleged damages were the proximate cause of his own provocation.

He also claimed the plaintiff is barred from recovery based on the Illinois Dram Shop Act.

VCG Holding Corporation is also named a defendant because it owned the nightclub at the time Basford was allegedly attacked.

Basford seeks a judgment of more than $200,000.

St. Clair County Circuit Judge Robert LeChien scheduled a mandatory status conference for Feb. 11 at 9:30 a.m.
