Alton medical practice seeks to dismiss malpractice suit over infected sutures

An Alton medical practice seeks to dismiss a malpractice lawsuit alleging a patient suffered infected sutures, arguing the plaintiff failed to submit a required affidavit.

Plaintiff Kristi Nasello filed her March 3 lawsuit against Alton Multispecialists Ltd., OSF Healthcare Systems, St. Anthony’s Healthsystem and Drs. Catherine L. Wikoff and Tim C. Kisabeth for medical malpractice.

According to the complaint, the plaintiff claims that during a follow up examination, the doctors discovered that Nasello’s sutures in the fatty tissue around her bowels caused severe infection, which then caused her bowels, bladder and intestines to drop.

The defendants filed a motion to dismiss the complaint on April 9 through attorneys Edward S. Bott and Mary L. Taylor of Greensfelder, Hemker & Gale.

They claim that in order to obtain damages for injuries for medical malpractice, the plaintiff must file a physician’s affidavit with the complaint, which Nasello failed to do.

In a May 21 memorandum to the court, the defendants stated that the plaintiff still hadn’t filed an affidavit.

Nasello seeks in excess of $250,000 in damages, plus costs.

She is represented by Gregory G. Fenlon and David W. Horan of Clayton.
