A man has sued a trucking business and two drivers, alleging vehicular negligence.
Nicholas D. Simmons filed a lawsuit May 15 in Madison County Circuit Court against Rene Paul Karteron, Charles S. Armstead Jr. and Schneider National Carriers Inc., alleging negligence in a 2013 accident.
According to the complaint, on June 1, 2013, Simmons was a passenger in a vehicle driven by Armstead traveling north on state Route 3 near its intersection with West Pontoon Road in Granite City when Karteron collided with their vehicle while operating a truck southbound on Route 3 in the scope of his employment with Schneider National.
The suit cites Karteron with: breach of ordinary care and negligence in failing to control his rig or reduce speed; driving at a dangerous speed; following the plaintiff’s vehicle too closely; and neglecting to brake, steer or otherwise maneuver his tractor-trailer to avoid the accident.
The complaint cites Armstead, in whose vehicle Simmons was a passenger, for failing to keep a proper lookout for other vehicles on the roadway. The plaintiff cites: injuries to the back, legs and neck; pain and suffering; disability and disfigurement; lost income and earning capacity; and medical expenses.
Simmons seeks damages in excess of $50,000, plus attorney fees and costs. He is represented by attorneys Rodney Caffey and Ralph Mendelsohn of The Caffey Law Firm in Godfrey.
