A woman and her passenger are suing another driver for allegedly causing an accident in 2013, injuring them both.
Trina Simmons and Rochelle Simmons filed a complaint on May 15 in St. Clair County Circuit Court against Ronald Baudino.
According to the complaint, at 5:59 a.m. on Sept. 15, 2013, Trina Simmons was driving her vehicle east on Interstate 64, just west of milepost 8 in Canteen Township, with Rochelle Simmons as a passenger. At the same time, Baudino was driving in the same direction and place and allegedly rear-ended Trina Simmons' vehicle, causing her and Rochelle to be injured.
The defendant is accused of negligence for failing to keep a proper lookout, failing to not strike the rear of Simmons' car and properly apply his brakes. He is also accused of operating a vehicle while intoxicated, at excessive speed and without adequate brakes the suit states.
As a result, both plaintiffs claim they suffered injury, pain and suffering, medical expense and loss of wages and earning capacity.
The plaintiffs seek damages in excess of $200,000, plus costs.
