Daughter killed in train accident; bereaved father seeks relief

A man whose daughter was killed when a Union Pacific Railroad train crashed into the vehicle in which she was a passenger, is suing the railroad, its conductor and engineer, and the car's driver for more than $50,000.

Stack does not move asbestos cases

Madison County Circuit Court Judge Daniel Stack, who established early on that he would dismiss cases based on forum non conveniens, did not allow two such motions during a recent hearing. But he made it clear to plaintiff attorneys that forum shopping will not be tolerated anymore under his administration of the county's large asbestos docket.

Vioxx-related suit filed in St. Clair County

East St. Louis resident Rosalyn Jackson filed an 11-count suit against Merck & Co. and Walgreen's claiming a stroke she suffered was caused by taking Vioxx.

Two FELA suits filed in St. Clair County

Dustin B. McCandless, a conductor who worked a year-and-a-half for Norfolk Southern Railroad, is suing the railroad for more than $50,000 alleging unsafe working conditions. McCandless claims he suffered serious injuries after he was assaulted in the Coapman Yard in East St. Louis on Sep. 12, 2004.

Neil B. Ford filed a wrongful death suit against Anderson Hospital, Legatus Emergency Services and Peter B. Malench, M.D. in Madison County Circuit Court on Jan. 21 claiming the hospital and its staff incorrectly diagnosed his daughter’s illness leading to her death.

Jones Act case filed in Madison County

Luke Myrick filed a Jones Act lawsuit Jan. 24 in Madison County Circuit Court alleging he was injured while working for Teco Barge Line of Metropolis.

American Legion altercation leads to dram shop suit

State high court overturns ruling

The Illinois Supreme Court overturned a May 28, 2002 ruling by Madison County Associate Judge Lewis Mallott in an insurance case where the plaintiff argued their payouts should be more because she had coverage for multiple vehicles, even though only one vehicle was involved in the accident.
