Passenger claims driver hit her while approaching his vehicle at the SIU-E campus

EDWARDSVILLE - A woman claims she was walking to a vehicle in a parking lot at Southern Illinois University Edwardsville when the driver hit her. 

The lawsuit was filed in the Madison County Circuit Court by Samantha T. Voss against Nicholas M. Foley, alleging negligence, battery, and assault. 

According to the complaint, Voss alleges she was a passenger in Foley's vehicle as they traveled through the Southern Illinois University campus. She was allegedly walking to his vehicle in a parking lot when Foley negligently drove into her, causing severe and permanent injuries to her eye, fingers, hip, knee, leg, foot and related areas.

Voss alleges Foley failed to keep a proper lookout for other persons or vehicles in the parking lot area and drove at a speed that was greater than reasonable given the conditions of the area and limited visibility of his surroundings. As a result of these alleged negligent acts, Voss claims she suffered great pain and mental anguish from her disabling injuries. 

Voss is seeking damages in excess of $50,000 for medical treatment costs and loss of income due to her inability to attend regularly scheduled classes or maintain regular employment. She is represented by attorney Robert H. Gregory of The Law Office of Robert H. Gregory PC.
