Motorist, passenger sue over rear end collision

EDWARDSVILLE - A driver and passenger are suing another motorist for allegedly causing a rear end collision. 

Jebediah Owens and Michael Burnette filed a lawsuit in the Madison County Circuit Court against Erin N. Balentine, formerly known as Erin N. Cranson, alleging negligence and personal injury. 

According to the lawsuit, Owens was driving north in the left lane on N. Bluff/Highway 157 on Feb. 13, 2021. Burnette was riding as a passenger. Owens was stopped in traffic at the intersection of Ramada Blvd. when the defendant allegedly failed to notice the stopped traffic and rear-ended Owens' vehicle. Owens in Burnette claim they were thrown about the vehicle violently and unexpectedly, causing them both to sustain serious and permanent injuries.

The plaintiffs claim the defendant was negligent by failing to keep a careful Lookout while operating a vehicle, failing to keep a safe distance between vehicles in front of her, operating a vehicle at an excessive and dangerous speed under the circumstances, failing to apply the brakes or otherwise take evasive action to avoid a collision and striking the rear end of another vehicle.

Owens claims he was caused to suffer physical injuries to his head, neck, and right shoulder. He also claims he endured pain and suffering, physical limitations due to his injuries, lost his enjoyment of life, lost future wages and incurred medical expenses. 

Burnette claims he was caused to suffer physical injuries to his neck, right hand and right wrist that will continue to require medical care and treatment. He also claims he endured pain and suffering, physical limitations, lost wages and incurred medical expenses. 

The plaintiffs seek an amount in excess of $50,000, plus post judgement interest and attorney's fees. They are represented by Todd R. Nissenholtz of St. Louis.
