Couple alleges Glen Carbon property sellers failed to disclose defects

EDWARDSVILLE - Glen Carbon homeowners are suing the property sellers for allegedly failing to disclose home defects. 

Justin and Nicole Wilkinson filed a lawsuit on Jan. 11 in the Madison County Circuit Court against Nathaniel and Jamie DeWitt.

According to the lawsuit, the Wilkinson's entered into a real estate contract with the DeWitts for the purchase of a single family home on Meridian Oaks Drive in Glen Carbon. The Wilkinsons allege the defendants did not disclose all material defects in regards to the home, therefore violating the Residential Real Property Disclosure Act. 

The Wilkinsons claim they found a settlement defect in the earth, causing the concrete driveway to become uneven and displaced. They also claim they found improper backfilling of underground utilities running across the front of the property, which the sellers of the home were allegedly legally obligated to disclose. 

The Wilkinsons seek an amount in excess of $50,000, damages for the amount required to repair the settlement and court costs. The Wilkinsons are represented by Jason D. Johnson of Manchester, Mo.
