Glen Carbon property owner alleges tenants caused property to be condemned

EDWARDSVILLE — A Glen Carbon property owner alleges tenants failed to maintain the property and allowed it to become so damaged that it was condemned by the village. 

 the failure of tenants to maintain and fix damage has caused the property to be condemned. 

R.L.P. Development Co., Inc., filed a complaint Sept. 15 in the Madison County Circuit Court against Sunrise Restaurants LLC and all known and unknown occupants, alleging breach of lease. 

According to the complaint, the plaintiff owns property located on Junction Drive in Glen Carbon and entered into various lease agreements with the defendants from January 2007 through December 2012. The plaintiff alleges the defendants have failed to maintain the property in good condition and allowed the property to remain in disrepair. Specifically, the plaintiff claims a fire caused damage to the property's kitchen, there are multiple roof leaks, ceiling collapses, broken trusses, molded insulation and electrical issues. 

The plaintiff further alleges the damages from the defendants have caused the property to be condemned by the Village of Glen Carbon, which resulted in the termination of the lease agreement. 

The plaintiff seeks compensation of more than $50,000 and all other just relief. It is represented by attorney Katherine Smith in Edwardsville.
