Passenger allegedly fell when bus driver suddenly accelerated

BELLEVILLE — A man alleges he was thrown to the ground and suffered injuries when a Bi-State bus driver accelerated before he could be seated.

Orrin Butler filed a complaint Feb. 1 in the St. Clair County Circuit Court against Bi-State Development Agency of the Missouri-Illinois Metropolitan District, alleging negligence. 

Butler alleges in his suit that he was entering a Bi-State bus on Feb. 1, 2019, on West Main Street in St. Clair County. He claims the bus driver "recklessly accelerated forward" while he was getting onto the bus, which caused him to be thrown to the ground and suffer "serious, painful and permanent" injuries to his side, foot, back and neck. 

Bulter alleges Bi-State was negligent because its driver failed to "exercise the highest degree of care" and failed to give Butler a "reasonable amount of time" to be seated on the bus before accelerating. Butler also claims the bus driver failed to give a verbal warning to alert him of the danger. 

He alleges his injuries are permanent and "progressive in nature" and have caused him to incur medical expenses. He also claims he will suffer future pain and suffering. 

Butler seeks monetary relief of more than $50,000, trial by jury and all other just relief. He is represented by R. Tyson Mutrux of The Mutrux Law Firm LLC in St. Louis.
