Suit alleges tractor trailer driver caused I-64 collision

BELLEVILLE —  A motorist is suing the driver of a tractor trailer and his employer after suffering injuries in a collision on Interstate 64.

Robert Whitford filed a complaint Jan. 8 in the St. Clair County Circuit Court against Marvin Roybal and RST Inc., alleging negligence. 

According to his complaint, Whitford was driving his vehicle westbound on I-64 in the Caseyville Township on Feb. 8, 2019. He alleges Roybal, an employee of RST who was driving a tractor trailer, collided with his vehicle. He claims Roybal "failed to stop or swerve" the tractor trailer "at the appearance of danger" to try and avoid the collision. 

Whitford also claims Roybal was traveling at a speed that was "greater than reasonable and proper with regard to traffic conditions" and failed to equip the tractor with "adequate" brakes or yield the right of way. Whitford alleges he suffered permanent injuries "both internally and externally" as a result of the collision. 

Whitford seeks monetary relief of more than $50,000 and all other just relief. He is represented by Daniel Finney, III of Brown & Brown LLP in Fairview Heights.
