Visitor alleges negligence led to injuries at Reside Here in Belleville

BELLEVILLE — A visitor is suing a Belleville landlord and property management company and its owner over injuries he allegedly suffered in a fall on the company's premises in April. 

In his seven-page complaint filed Aug. 27 in St. Clair County Circuit Court, Gary Fenwick sued John Kerley and Kerley Properties, LLC, which does business as Reside Here, with its business location on Ben Louis Drive in Belleville, alleging negligence. Fenwick seeks "a fair and just award" of more than $50,000 for each of the two counts of negligence he claims in his complaint, plus costs of suit.

Fenwick alleges Reside Here had a duty "to keep the premises in a reasonably safe condition for [Fenwick] and other persons lawfully in and about the premises and, further, not to create or allow any dangerous conditions to exist on or about the premises."

Fenwick says in his complaint on April 25, he "was walking on the premises down the stairs leading to the laundry room and parking garage, under the first floor units, when he slipped on a foreign substance which had accumulated on the floor, causing him to fall and sustain severe injuries."

The plaintiff alleges he was "made sick, sore, lame, disordered and disabled and suffered extensive injuries to his head, body, and limbs, both internally and externally," plus injuries to his right shoulder, right wrist in "the soft tissues of the cervical and shoulder area." 

The injuries have and will require medical attention and Fenwick "has suffered disability, has experienced pain and suffering and will be reasonably certain to experience pain and suffering in the future as a result of the injuries," the complaint said.

The plaintiff alleges the defendant should have know about the dangerous condition.
