Man alleges excessive force while escorted from tavern

EDWARDSVILLE — A customer alleges he fell while being escorted from The Corner Tavern. 

James M. Gavin filed a complaint on Jan. 16 in the Madison County Circuit Court against TSBN Cleo's Tavern, doing business as The Corner Tavern, alleging the restaurant operator's employees breached their duties to escort him safely out of the premises.

According to the complaint, the plaintiff alleges that on July 18, 2017, he was a customer at The Corner Tavern when he was told to leave by a bartender. However, he claims the defendant's employees pushed and shoved him out of the door when escorting him off the premises. As he was leaving, he claims he fell and suffered a left distral radius intra-articular fracture. 

Gavin claims he suffered severe pain and suffering and medical expenses for operative treatment. 

The plaintiff alleges the defendant's employees negligently used excessive force in escorting him out.

The plaintiff requests a trial by jury and seeks damages of not less than $50,000, plus costs of this action and any further relief that the court may deem just and proper.
