J&D Trucking Inc. seeks damages from escort company after load struck bridge

EDWARDSVILLE – A Colorado corporation alleges an O'Fallon company and a Missouri company failed to perform a route survey needed for the plaintiff to haul an oversize load.

J&D Trucking Inc. filed a complaint on Dec. 28 in the Madison County Circuit Court against Emerald Equipment Escorts, Carla Hendrix and Ed Hendrix, both doing business as Eddie's Pilot Car Services, alleging breach of duty.

According to the complaint, the plaintiff was hauling a load in December 2012 and the defendants were the lead escort for the oversize load. The suit states that while hauling the load, the Hendrix defendants told the plaintiff's driver that the load would clear under the Herrin Road Bridge over Interstate 64, but the cargo struck the underside of the bridge, causing damage to the plaintiff's tractor.

The plaintiff alleges the defendants failed to correctly measure the load to ensure proper clearance, failed to perform a route survey and failed to obey regulations regarding permitting of loads.

The plaintiff seeks judgment against defendants of more than $50,000, plus costs of suit.
