Woman alleges injuries in trip, fall at O'Fallon car dealership

BELLEVILLE — A woman is suing an O'Fallon car dealership after she allegedly tripped and fell on an uneven sidewalk.

Sharon Rose of Madison County filed a complaint on Feb. 6 in the St. Clair County Circuit Court against Meyer Bros. Auto Co., doing business as Meyer Honda Co., alleging the defendant failed to keep its premises in a reasonably safe condition.

According to the complaint, Rose alleges that on Feb. 10, 2015, she was on the defendant's premises attempting to enter the service reception area. While attempting to enter the building, she walked from the asphalt driveway onto the sidewalk, tripping on the uneven lip of the sidewalk and falling to the ground.

As a result, Rose claims she suffered physical injuries, including a fractured arm and shoulder.

The plaintiff alleges Meyer Honda failed to warn customers of the dangerous condition of the uneven sidewalk leading to the entrance doors, failed to demarcate the elevation changes of the sidewalk with yellow paint and failed to design and construct the sidewalk or driveway in compliance with federal, state and municipal regulations.

The plaintiff requests a trial by jury and seeks judgment in an amount in excess of $50,000, plus costs of suit, and for such other and further relief as may be just and proper.
