Woman claims motorist struck parked car

BELLEVILLE — A woman is suing a motorist who allegedly struck her parked vehicle while she was in the Jack-in-the-Box parking lot.

Heather Barham filed a complaint on Feb. 23, in the St. Clair County Circuit Court against Charles Alexander alleging that the defendant failed to exercise ordinary care and caution while operating his vehicle in the parking lot.

According to the complaint, the plaintiff alleges that on Feb. 27, 2015, the defendant collided with the rear of her 2011 Ford Fusion while she was parked in the Jack-in-the-Box parking lot.

As a result, Barham claims that she suffered physical injuries, lost wages and incurred medical expenses.

The plaintiff alleges the defendant failed to keep a proper lookout in the parking lot, failed to yield right of way and failed to take proper caution while driving his vehicle in the parking lot.

The plaintiff requests a trial by jury and seeks judgment for an amount exceeding $50,000 plus such other relief as the court deems appropriate.
