Delivery man alleges injuries from dog bite

BELLEVILLE — A delivery man claims he was injured when a customer's dog bit his hand.

Daniel Baker filed a complaint on Sept. 21 in St. Clair County Circuit Court against Joseph Kemper, alleging that the dog owner negligently allowed his dog to attack the plaintiff.

According to the complaint, the plaintiff alleges that he was lawfully on the defendant's property delivering Chinese food to the defendant. As he approached the door, the defendants's dog rushed to the door and forcibly opened it, then bit and locked its jaw on the plaintiff's hand, resulting in severe injuries that caused him to suffer damages, the suit says.

The plaintiff alleges Kemper failed to display any sign on his property that included the words "bad dog" and failed to leash his dog properly.

The plaintiff requests a trial by jury and seeks compensation for damages in an amount of $100,000, plus interest and attorney's fees. He is represented by Michael T. Harvath of Harvath Law Offices in Pacific, Mo.
