BELLEVILLE — An Illinois woman is suing a Belleville convalescent center, alleging its negligence led to the plaintiff suffering a broken hip.

Rose M. Porter filed a lawsuit Aug. 4 in St. Clair County Circuit Court against Helia Healthcare of Belleville LLC, doing business as Four Fountains Convalescent Center alleging failure to comply with the Nursing Home Care Act.

According to the complaint, on Feb. 3, Porter was admitted at Four Fountains after sustaining a fracture from a fall. On that same day, the suit says, Porter needed to use the restroom and was told by a defendant's employee that she could go there on her own. 

While going to the restroom, the suit says, Porter allegedly fractured her left hip and sustained severe personal injury, plus hospitalization and medical expenses.

The plaintiff alleges the defendant failed to provide assistance, failed to properly supervise her and failed to implement fall prevention interventions.

Porter seeks a trial by jury, judgment of more than $50,000, plus costs of suit and attorney fees. She is represented by attorneys Lanny Darr of Darr Law Offices Ltd. in Alton, and by Michael Sudekum of Mendel & Mendel in St. Louis.
