Accountant alleging data loss sues computer firm

State Farm is suing on behalf of an accounting company alleging its principal suffered damages when a computer company failed to replace a hard disk drive while repairing the machine.

State Farm Fire & Casualty Co. filed a lawsuit on June 18 in St. Clair County Circuit Court on behalf of J.W. Boyle Co. Ltd. against Computype I.T. Solutions, both of Belleville, claiming that the defendant was responsible for server failure at the plaintiff’s place of business in January 2013.

According to the filing, the insured’s principal, listed as Mr. Glueck, contacted the defendant for assistance in January when his hard disk drive (HDD) server emitted noise. The suit states that Computype removed the HDD but did not replace it.

The plaintiff claims that on April 1, 2013, Glueck was unable to access data on the server and once again contacted the defendant, who allegedly re-installed the hard drive.

The suit states that Computype acted negligently when it failed to restore the insured’s server to an optimal functioning level, provide backup of the system and replace the hard disk drive.

State Farm alleges that its insured suffered damages and seeks reimbursement of a total amount of $50,356.66, plus attorneys’ fees and costs. The firm is represented by Chiles & Associates in Wheaton.
