Passenger blames grocery store where driver purchased, consumed alcohol

A man has filed suit against the grocery store where he claims a driver bought alcoholic beverages, then caused a collision after ingesting them.

Jalen Smith filed a lawsuit Aug. 23 in Madison County Circuit Court against Supervalu, Shop N’ Save Warehouse and Valcour Development Company.

In his complaint, Smith alleges he was riding in a vehicle Nikolas Becoat was driving on Aug. 25, 2012, when Becoat caused an accident. Just before the collision, Becoat had consumed alcohol he had purchased from defendant Shop N’ Save, according to the complaint.

Because of the accident, Smith experienced pain and suffering, incurred medical costs of more than $68,000, incurred medical costs, became disabled and disfigured and was unable to pursue his normal activities, the suit states.

In his complaint, Smith seeks a judgment of more than $150,000, plus costs.
