A Belleville medical center being sued by a phlebotomist who claims she was attacked at work claims the injuries she sustained were the result of her own negligence.

Stephanie R. Moslander filed a complaint Oct. 2 in St. Clair County Circuit Court against Midwest Rehabilitation & Respiratory Center LLC, Belleville Rehabilitation and Nursing Center LLC.

Eldercare Inc., doing business as Calvin Johnson Care Center, and Senior Healthcare Management LLC, were also listed as defendants.

Moslander claims she was working at the Calvin Johnson Care Center in February 2011, when she was “physically and sexually attacked and battered.”

Moslander accuses the defendants of negligence for allegedly failing to take the necessary steps to protect her.

In a Feb. 7 answer to the complaint, Eldercare claims Moslander failed to state a claim upon which relief can be granted. The company also stated it is not liable for any losses caused by the plaintiff.

Eldercare demands a trial by jury.

Attorney Stephen J. Telkin of East St. Louis represents Moslander.

Charles L. Joley and Georgiann Oliver of Joley, Nussbaumer, Oliver & Beasley in Belleville represent Eldercare Inc.

The case is assigned to St. Clair County Circuit Judge Robert LeChien.
