Washington County accident is subject of St. Clair County suit
A woman has filed suit against the driver who she claims failed to obey a stop sign and struck her vehicle.
Peggy J. Musial alleges her daughter, Alexandria N. Musial, was driving a 2010 Pontiac Grand Am east on County Highway 17 in Washington County on Feb. 6, 2010, when defendant Robert J. Niedbalski, who was driving a 1994 Buick Skylark near an intersection with the highway, failed to stop at a stop sign as he attempted to turn left. Niedbalski crashed into the vehicle Musial was driving, according to the complaint filed Jan. 31 in St. Clair County Circuit Court.
Because of the collision, Alexandria Musial incurred medical costs, experienced a damaged earning capacity and sustained pain and suffering, the suit states. In addition, her ability to move has been restricted and she has suffered from a loss of her enjoyment of life, the complaint says.
Peggy Musial claims she was responsible for her daughter's medical bills until Alexandria Musial turned 18 on Sept. 29, 2010.
Musial blames Niedbalski for causing the collision, saying he negligently failed to yield the right-of-way, failed to keep his vehicle under proper control, failed to keep a proper lookout and drove without adequate brakes.
In her two-count complaint, Peggy Musial is seeking a judgment of more than $100,000, plus costs.
She will be represented by Robert C. Nelson of Nelson and Nelson in Belleville.
