A man has filed suit against the driver who he claims failed to yield the right-of-way at a stop sign and struck his vehicle.
Paul F. Tolden claims he was driving west on U.S. Highway 50 near its intersection with North Eagle Center in O'Fallon on Sept. 14, 2009, when defendant Paul J. Bonn, who was driving a 1999 Toyota Sienna, failed to yield to Tolden's vehicle and struck it.
Because of the collision, Tolden suffered severe and permanently disabling injuries to his head, neck and back and sustained great pain and mental anguish, according to the complaint filed Aug. 11 in St. Clair County Circuit Court. In addition, he lost his ability to pursue his job, suffered permanent disability and disfigurement and incurred medical costs, the suit states.
Bonn negligently failed to keep a proper lookout, failed to reduce his speed to avoid a collision, failed to stop at a designated stop sign, failed to yield to other vehicles and failed to keep his vehicle under control, the complaint says.
In his suit, Tolden is seeking a judgment of more than $50,000, plus costs.
