A man says he sustained severe neck, back and spinal injuries after the driver of a Toyota Corolla failed to yield at a stop sign.
Justin McElroy filed a lawsuit Jan. 12 in Madison County Circuit Court against Elvis Flowers.
McElroy claims he drove a 2001 Ford Explorer west on 25th Street and across its intersection with Adams Street in Granite City on Oct. 21, 2008, when Flowers, who drove a 1997 Corolla south on Adams Street, struck him.
"That at said time and place, the Defendant had a stop sign at said intersection, but the Plaintiff did not have a stop sign as he traveled along 25th Street," the suit states. "That at said time and place, the Defendant failed to yield the right-of-way of the Plaintiff at the intersection of 25th Street and Adams Street in the City of Granite City, County of Madison, and State of Illinois."
In addition to his severe injuries, McElroy suffered great physical pain and mental anguish, became hindered from attending to his regular affairs and duties and lost large sums of money, the complaint says. He also incurred medical costs, according to the complaint.
McElroy blames Flowers for failing to bring his vehicle to a stop at the intersection, for failing to keep his vehicle under proper control and for failing to yield the right-of-way to McElroy.
McElroy seeks a judgment of more than $50,000, plus costs.
