Collinsville Acquisitions files breach suit

Collinsville Acquisitions has filed a breach of contract complaint against Klutch Enterprises and its two principals, alleging they failed to pay past and future rent.

Represented by Christopher W. Byron and Christopher J. Petri of Byron, Gerber, Petri & Kalb in Edwardsville, Collinsville Acquisitions claims Klutch and James and Nicole Sanders agreed to pay rent but have either underpaid or failed to make rent payments throughout the lease, then abandoned the leased premises in late 2007 or early 2008.

"Through April of 2008, Klutch owes CA approximately $27,171.68 in unpaid rent and late fees," the complaint filed Sept. 17 in Madison County states.

They also owe for future rent payable, CAM charges, attorney's fees, which amount to more than $230,000, the suit states.

Because they are guarantees of Klutch's obligations, the Sanders owe the same amount, Collinsville Acquisitions states.

In addition to the $230,000 from each defendant, Collinsville Acquisitions is seeking attorney's fees, any applicable costs and interest and any other relief the court deems proper.
