Falling linoleum roll causes customer's 'internal derangement'

Delores Yancey filed suit against Home Depot in Madison County Circuit Court Sept. 21 alleging injuries from a falling linoleum roll.

"Yancey was standing in the store when, through no fault of her own and without having touched any piece of the linoleum roll or linoleum roll display rack, a large roll of linoleum fell off the rack, striking plaintiff," the complaint states.

The incident took place at an Edwardsville store on April 15, 2004. She claims Home Depot failed to warn her of dangerous conditions on its property, failed to inspect its property for hazards and failed have the rolls securely fastened.

According to the complaint, Yancey sustained injuries to her left foot, suffered an "internal derangement of the injured members of her body," required medical attention, and has been prevented from participating in many of her usual daily activities.

Yancey, represented by Richard Reed of Belleville, is seeking damages in excess of $50,000 plus costs of the suit.

The case has been assigned to Circuit Judge Daniel Stack.
