54th Street Bar and Grill blames customer for contributing to alleged damages

An Edwardsville restaurant denies allegations in a lawsuit alleging a customer was injured when she slipped and fell.

Plaintiff Loretta Boston filed the Sept. 19 lawsuit against Kellan Restaurant Management Corp., doing business as 54th Street Bar & Grill.

According to the complaint, Boston claims she was injured while visiting the restaurant on Sept. 24, 2012. She alleges she was walking to the restroom in the areas of the server’s station when she “slipped due to a liquid substance on the floor that caused her to fall and be injured.”

Boston accuses the defendant of negligence for allegedly failing to keep patrons safe.

54th Street answered the complaint on Oct. 23 denying the allegations and arguing that the plaintiff contributed to her own injuries.

Circuit Judge Dennis Ruth scheduled a case management conference for June 24 at 9 a.m.

Boston seeks more than $50,000 for medical expenses, pain and suffering.

John N. Cannon of McCarthy, Rowden & Baker in Decatur represents Boston.

Daniel R. Schattnik of Unsell, Schattnik & Phillips in Wood River represents the defendant. It request a jury trial.
