A pick-up driver is suing over an automobile accident that happened while she was attempting to merge onto Interstate Route 255.

Plaintiff Allison R. Wagner filed the lawsuit against Jessica K. Diego on Oct. 21 in the St. Clair County Circuit Court.

According to the complaint, Wagner was driving a pick-up truck going northbound on I-255 on Sept. 1, near mile post 21 in St. Clair County. At the same time, Diego was driving an automobile going east on I-64 and was attempting to merge onto I-255.

Wagner alleges Diego collided with her vehicle while trying to merge, the suit states.

Wagner accuses Diego of negligence for driving her vehicle at a speed greater than reasonable and proper, failing to drive her vehicle within a single lane of traffic, failing to adjust her speed and lateral position to avoid colliding with the pick-up truck, failing to keep a proper lookout ahead and failing to stop, slow down or swerve to avoid colliding with the plaintiff.

As a result of the accident, the plaintiff sustained injuries to various parts of her body causing her pain and permanent disability, the complaint states.

Wagner claims she will incur future medical expenses in an attempt to treat her injuries.
Wagner seeks a judgment of more than $50,000 in damages for pain and suffering, lost wages and medical expenses, as well as costs of the suit.
