Larry Flynt's Hustler Club seeks medical records of plaintiff involved in accident

A Washington Park strip club is seeking medical records from a plaintiff who blames the establishment for over-serving the patron with whom she accompanied to the club.

Cynthia Nicole Allen filed a lawsuit Jan. 16 in Madison County Circuit Court against Charles E. Hall, Thomas Williams, doing business as Runway Lounge & Package Liquor and Déjà vu Showgirls –Washington Park, doing business as Larry Flynt’s Hustler Club.

WP 5420 Bunkum LLC, owner of the property used by the club, was also named a defendant.

Allen claims she was a passenger in a vehicle being driven by Hall after they left the club in August 2012. She claims they were on Collinsville Road near the intersection of Kingshighway, when Hall hit a utility pole and rolled the car.

Allen claims her legs and pelvis were hurt in the crash.

She accuses Hall of negligence and accuses the other defendants of violating the Illinois’ Dram Shop Act for serving alcohol to an already intoxicated Hall.

Déjà vu Showgirls and WP 5420 Bunkum, LLC, filed a motion for a HIPAA order April 18, stating the defendants wanted to obtain Allen’s medical records from her treatment providers.

The defendants say Allen’s medical condition is “at issue.”

Chicago attorney Patrick Ruberry will appear before Madison County Chief Judge Ann Callis April 24 to present his motion for a HIPAA order.

Defendants WP 5420 Bunkum and Déjà Vu Showgirls both responded to the complaint, stating the plaintiff was guilty of complicity in that she willingly caused the intoxication of the alleged intoxicated person by furnishing him with all or part of the liquors which caused his alleged intoxication.

The plaintiff asks for more than $50,000 in damages for medical expenses, loss of income and court fees.

She is represented by attorney Steven W. Selby of Alton.
