A Bank of America customer who claims she could not use a drive-through lane due to a staffing shortage at a Swansea location, is suing over injuries she alleges she sustained on an icy sidewalk.
Terrie A. Holder filed suit against the bank and H&M Backhoe Service on Feb. 18 in St. Clair County Circuit Court.
Holder claims the incident happened Feb. 15, 2014, on her way from her car to the bank lobby.
She claims the bank failed to provide safe ingress and egress, failed to open the drive-through considering the unsafe conditions and failed to clean the sidewalk so she could safely traverse the sidewalk,
H&M Backhoe Service was named a defendant because it was under contract with the bank to remove snow and ice from the premises. She claims the company was negligent in removing and remediating snow and ice.
Holder says that she suffered a fractured ankle as a result of her fall.
She seeks in excess of $50,000 in damages.
