Pedestrian says driver struck him in Wood River Wal-Mart lot

A Wood River man claims he sustained severe injuries after a driver struck him as he was walking through Walmart’s parking lot.

Charles Foster filed a lawsuit Nov. 21 in Madison County Circuit Court against Jennifer D. Byrd.

In his complaint, Foster alleges he was walking back to his car, which was parked in the Wood River Walmart’s parking lot, when Byrd struck him as she attempted to back her vehicle out of its parking space.

Because of the accident, in addition to his severe injuries, Foster suffered pain, lost wages, lost his enjoyment of life and experienced suffering and disability, according to the complaint.

Foster blames Byrd for causing the collision, saying she negligently failed to keep a proper lookout and failed to exercise reasonable care to avoid a collision.

In his complaint, Foster seeks a judgment of more than $50,000, plus other relief the court deems just.

Matthew P. Young of The Kuehn Law Firm in Belleville will be representing him.

Madison County Circuit Court case number: 12-L-1915.
