St. Clair County jury awards $1 million in medical malpractice case

A St. Clair County jury on Feb. 26 awarded $1 million to a plaintiff in an 11-year-old wrongful death-medical malpractice case against a Belleville anesthesiologist.

Donald Paul Brown brought the case against Dr. Daniel P. Gillen, St. Clair Anesthesia and St. Elizabeth’s Hospital and others in 2003, alleging negligence in the death of Margaret Janet Brown.

According to the complaint, Gillen failed to obtain consent to use a Swan-Ganz catheter during coronary artery bypass surgery and failed to properly perform and monitor the catheterization.

The patient was 71 when she died Oct. 28, 2002.

St. Elizabeth’s Hospital, represented by Michael Nester of Belleville, settled with the plaintiff shortly before trial on Feb. 20 for an undisclosed sum.

Brown was represented by Joseph Bartholomew of Cook, Ysursa, Bartholomew, Brauer & Shevlin in Belleville.

Attorneys Gregory Minana, Angela S. Quinn and Nathan Sturycz of Husch Blackwell Sanders in St. Louis represented Gillen and St. Clair Anesthesia.

The case had been presided over for years by Circuit Judge Robert LeChien.

Circuit Judge Andrew Gleeson presided at trial.
