Med mal complaint alleges doctors failed to diagnose lung cancer

The husband of a recently deceased woman claims her doctors failed to diagnose her with lung cancer, which led to her death.

Dave Abbott filed a lawsuit Oct. 23 in St. Clair County Circuit Court against Protestant Memorial Medical Center doing business as Memorial Hospital Advanced Radiology Associates; Drs. Wallace Anderson, Nina Luxenberg and Nidal Shawahin; and P.C. Associates doing business as Internal Medical Specialists of Southern Illinois.

In his complaint, Dave Abbott alleges the defendants failed to properly interpret chest imaging taken from his wife, Dolores Abbott. As a result, Dolores Abbott died from lung cancer on Jan. 12, 2012, according to the complaint.

Because of Dolores Abbott’s death, her husband and three children have suffered grief, sorrow and permanent injuries and have been deprived of her services, companionship, comfort, guidance, instruction, counsel, training, love and support, the suit states.

In his complaint, Dave Abbott is seeking a judgment of more than $300,000, plus costs.

Joseph A. Bartholomew of Cook, Ysursa, Bartholomew, Brauer and Shevlin in Belleville will be representing him.

St. Clair County Circuit Court case number: 13-L-545.
