EDWARDSVILLE — A property buyer is suing the seller for allegedly fraudulently misrepresenting the condition of the property.
Michael Jascur filed a complaint on Jan. 14 in the Madison County Circuit Court against Speed Lube LLC and Steven C. Dugan, alleging tortious interference and unjust enrichment.
According to the complaint, the plaintiff alleges that in March 2018, the parties began discussions concerning the purchase of property at 429 Walnut St. in Highland. The plaintiff alleges the defendants falsely represented that the property suffered no environmental ailments and that it was immediately ready for Jascur's commercial purpose.
However, Jascur alleges he was forced to forfeit his earnest money deposit of $5,000 and incurred additional expenses for environmental testing as well as necessary renovations and improvements made to the property.
The plaintiff requests a trial by jury and seeks judgment against the defendants, jointly and severally, for all damages, attorney's fees, costs and expenses and all other relief that is proper and just.
