Motorist alleges insurer failed to provide coverage

EDWARDSVILLE — A motorist is suing another driver and Unique Insurance for allegedly failing to provide coverage following a rear-end collision. 

Brooke Atterberry filed a complaint on Dec. 4 in the Madison County Circuit Court against Unique Insurance Company and Francisco Garcia-Hinojosa, alleging negligence and breach of contract. 

According to the complaint, the plaintiff alleges that on April 5, 2017, she was driving eastbound on Horseshoe Lake Road when Garcia-Hinojosa allegedly rear-ended the plaintiff's vehicle. 

Atterberry claims she sustained injuries to her upper back and right and left shoulders. She also claims she incurred medical and costs. 

The plaintiff alleges Garcia-Hinojosa negligently lost control of the vehicle he was driving. She also alleges Unique failed to provide coverage for her medical expenses, pain and suffering through her uninsured motorist coverage.

The plaintiff requests a trial by jury and seeks judgment against the defendants in an amount between $25,000 and $75,000, plus all other relief that is proper and just. She is represented by Celestine Dotson of Celestine Dotson Law Office in St. Louis.
