Policy holder alleges insurer denied long-term disability benefits

BENTON — A policy holder is suing her insurer for allegedly terminating her benefits. 

Lori A. TeVault filed a complaint on Oct. 16, in the U.S. District Court for the Southern District of Illinois, against Liberty Life Assurance Co. of Boston, alleging violation of the Employee Retirement Income Security Act. 

The plaintiff alleges that in 2015 she was a participant of the Sherwin Williams Long Term Disability Plan underwritten by the defendant. 

On April 26, 2016, she stopped receiving her LTD benefits to which she is entitled. The plaintiff holds Liberty Life Assurance responsible because the defendant allegedly terminated her benefits under the 24-month period of limitations and denied her a full and fair review of her claim.

The plaintiff requests a trial by jury and seeks an order requiring defendant to pay her disability income benefits, with interest, costs, attorney’s fees, and all other penalties, damages, and relief. She is represented by Kevin Linder of Linder Law Office in Springfield.
