Son blames Emerald Pointe in Greenville for father's death

EDWARDSVILLE — The operator of a independent residential facility faces a wrongful death lawsuit as a result of a fall on the property.

David Wilson, as personal representative of the estate of Robert Wilson, filed a complaint on Oct. 2 in Madison County Circuit Court against HSHS Holy Family Hospital Inc. and Hospital Sisters Health System.

According to the complaint, Robert Wilson was returning to his leased room at Emerald Pointe living facility in Greenville when he fell on the sidewalk. He sustained injuries that resulted to his death, the complaint states. The plaintiff claims he suffered significant medical and funeral expenses. The plaintiff alleges the defendants, who own the facility, failed to provide handrails on the sidewalk where Robert Wilson fell.

The plaintiff requests a trial by jury and seeks judgment against the defendants for damages in excess of $50,000, plus costs. He is represented by Stephen C. Mudge and Jennifer M. Wagner of Reed, Armstrong, Mudge & Morrissey PC in Edwardsville.
