EDWARDSVILLE — An Alton property owner filed a class action lawsuit against the city for allegedly failing to serve a grass-cutting lien personally or by certified mail.
S & J Real Property LLC, individually and on behalf of all others similarly situated filed a complaint on Aug. 21, in the Madison County Circuit Court against City of Alton, alleging that the municipal government falsely recorded removal costs liens on plaintiff's property.
According to the complaint, the plaintiff alleges the defendant purported grass mowing / weed eating at plaintiff's property located at 946 Union Street in Alton in the amount of $108.70. The plaintiff suffered actual damages as well as attorney's fees and costs in pursuing this action.
The plaintiff holds Alton responsible because the defendant allegedly failed to serve the grass cutting lien personally or by certified mail to the person whom the property tax bill was sent to.
The plaintiff requests a trial by jury and seeks an order certifying this action as a class action and designating plaintiff and its counsel as class counsel. It also seeks an award for actual damages, attorney's fees, costs and all other relief deemed just and proper. It is represented by Shari L. Murphy of The Law Offices of Shari L.
